## Statutory Overview
The Party Wall etc. Act 1996 provides a mandatory legal framework for preventing and resolving disputes in relation to party walls, boundary walls, and excavations near neighbouring buildings in England and Wales.

## Section 1: Construction of New Walls at the Line of Junction

- **Section 1(5)**: Building a new wall wholly on the building owner's own land up to the boundary line. Notice period: Minimum 1 calendar month before commencement.

## Section 2: Rights of Building Owner in Respect of Existing Party Structures
A building owner has statutory rights under Section 2(2) to:
- **Section 2(2)(a)**: Underpin, thicken, or raise a party structure or party fence wall.
- **Section 2(2)(b)**: Make good, repair, or demolish and rebuild a party structure.
- **Section 2(2)(f)**: Cut into a party structure (e.g. inserting structural steel beams/RSJ padstones for loft conversions or knock-throughs, or cutting weather flashings).
- **Section 2(2)(g)**: Cut away projecting footings, chimney breasts, jambs, or flues on a party wall.
- **Statutory Notice Period**: Minimum 2 calendar months before work commences (Section 3(1)).

## Section 6: Excavation and Foundation Proximity Triggers (3m & 6m Rules)
- **3-Metre Rule (Section 6(1))**: Triggered when excavating within 3.0 metres horizontally of any part of an adjoining owner's building or structure AND the excavation extends to a lower level than the bottom of their foundations ($D_{\text{prop}} > D_{\text{neigh}}$).
- **6-Metre 45° Plane Rule (Section 6(2))**: Triggered when excavating within 6.0 metres horizontally of an adjoining owner's building or structure AND the excavation cuts a plane drawn downwards at $45^\circ$ from the bottom of their foundations ($D_{\text{prop}} > D_{\text{neigh}} + \text{Horizontal Distance}$).
- **Mandatory Attachments (Section 6(5))**: Every Section 6 Notice is legally invalid unless accompanied by site plans and cross-section drawings showing the depth and position of the proposed excavation. Notice period: Minimum 1 calendar month.

## Section 10: Statutory Dispute Resolution & Surveyor Fee Liability
- **14-Day Statutory Response Window**: An adjoining owner has 14 days from service of a statutory notice to consent in writing. Silence after 14 days is a deemed dissent under Section 5 / Section 6(7).
- **10-Day Final Request (Section 10(4))**: Following dissent or non-response, if a party fails to appoint a surveyor within 10 days of a formal request, the other party may appoint a surveyor on their behalf.
- **Surveyor Fee Rule**: Under established Party Wall practice and Section 10(13), the Building Owner undertaking the works is ordinarily liable for 100% of the reasonable fees of both the Building Owner's Surveyor and the Adjoining Neighbour's Surveyor (£0 cost to the Adjoining Neighbour).
